Analysis Of Bitcoin Transaction Contract Dispute Cases

Since its listing in 2009,bitcoin,as a brand-new point-to-point virtual currency,has been rapidly expanding and circulating in the world with its characteristics of decentralization and anonymity,which has attracted the widespread favour of Chinese currency circle enthusiasts and attracted many consumers to buy and trade bitcoin.By 2020,the number of users that China pays attention to,purchases,trades and holds has exceeded 10 million,and China once became the second largest bitcoin trading market in the world.Due to the late development in the field of bitcoin in China,the legal norms and market supervision system related to bitcoin are in an imperfect state,which leads to more and more legal disputes in judicial trials in recent years.Judging from the contents of the normative documents on the introduction of virtual currency such as bitcoin,China is still in a state of conservative prohibition in the field of bitcoin.Since the issuance of the bitcoin regulatory documents in 2017,most of the bitcoin trading platforms have been closed,and some of them have been forced to leave the country,which has led to the chaos of private and improper transactions and numerous disputes.There are more and more cases of bitcoin related contract disputes in the real judicial trial.Due to the lack of clear definition of the legal attributes of bitcoin in China,many highly similar cases of bitcoin contract disputes have different judgments of courts,which makes many bitcoin traders appeal to the decisions of the court.This not only causes huge economic losses to bitcoin holders,but also wastes resources of judicial organs.This paper mainly takes the domestic judicial trial cases of bitcoin transaction contract disputes as the starting point of this paper,selects three representative judicial trial cases as the perspective,and conducts in-depth research on the dispute focus of the transaction contract disputes.By combing three cases of bitcoin contract disputes,this paper puts forward the dispute issues,legal analysis,and finally combined with the court's judgment and the author's summary,in view of the problems of bitcoin,it puts forward relevant suggestions and enlightenment.
