A Study On The Vicissitudes Of Chinese Government Legal Advisory System From The Perspective Of Historical Institutionalism

Because scholars for the government legal system basic belongs to the cross-sectional study,the analysis of the lack of vertical research,so the paper from the vertical and horizontal two dimensions,analyzing the historical vicissitude process of the government legal system itself and the implementation of the current situation and existing problems,and points out tha t system optimization path selection.Mainly using the system generated,path dependence,"historical veto point",performance analysis of theory and so on are analyzed in detail,pointed out that the system is in the old and the new system of conflict in t he bud and power relations under the old system generation created opportunities for it.However,the change of the system is always bound by factors such as political performance competition and exit cost,which is easy to form path dependence.In additio n as a result of the government legal system itself is not comprehensive,the obstacles of relevant interest groups and political culture of the lack of system culture and ecological culture "circle culture",our country government legal system can enter s ystem fault period,this is not conducive to the implementation of the government legal system and perfect.Then looking back on it at present,the government legal system of input and output,is a commitment,there are staff into a high number,but the ov erall quality is not high,the system lack of relevant supporting mechanisms,has no specific operational funds pay system;Second,in terms of output,the comprehensive quality of government legal advisers is uneven,and the opinions of the legal advisers are limited.The relationship between the government and the legal adviser is not clear enough in practice.Then it is pointed out that our country can from the implementation of the government legal system mechanism,the effectiveness evaluation mechanism as well as the construction of a harmonious government and legal relations,to optimize the current government legal system,hope that the government legal system to an optimized path,and form a good path dependence,so that the government legal system can better development in our country.
