With the development of society,the advancement of science and technology and the popularization of mobile smart phones,WeChat has become one of the indispensable tools for people to work,study and communicate.However,WeChat provides people with a convenient way of communication and a new way of experience,which also provides new convenience for criminal activities and opens up new soil for criminals.In recent years,the crime that is associated with micro letter shows a tendency of growth,which not only seriously affect the users to use micro letter the software experience,but also to the people's property and social stability of the disturbing factors.Therefore,it is particularly important to study the related crimes of WeChat,especially the use of WeChat for property fraud.This article first study of the concept of WeChat fraud crime,from a different perspective for WeChat fraud crime,based on the current scholars for the different understanding of the definition of WeChat fraud crime,put forward the authors understanding of the definition of WeChat fraud crime,namely WeChat fraud crime refers to the use of WeChat platform function implemented fraud others public or private property,shall organize the prevention from the state and society level activities.Second gathering WeChat fraud crime related cases in recent years,summarized and concluded WeChat fraud crime with the characteristics and types,such as WeChat fraud crime presents the crime randomness,crime subject to young adults,criminals often through wechat business circle of friends,scanning WeChat qr code and send false part-time class information methods such as the implementation of fraud.WeChat fraud is not an accident,there must be a reason.The author summarizes the causes of WeChat fraud from three aspects of legislation,judicatory and personal,and finds out the shortcoming of the punishment of WeChat fraud from the causes of WeChat fraud.On the basis of this,the author puts forward relevant countermeasures,first,to improve the countermeasures of criminal law legislation and judicialinterpretation.Second,the idea of increasing the crime of network fraud and aiding the crime of online fraud;Thirdly,it puts forward the judicial countermeasures to deal with the network fraud crime such as WeChat.Fourth,enrich the social prevention countermeasures of WeChat fraud crime.Through the above four countermeasures,we will create a governance system to punish WeChat fraud.
