The Exploration Of Consumer's Right Of Rescission In Shopping Online

On March 15,2014,the new Law on the Protection of Rights and Interests of Consumers,as amended by the NPC,formally introduced the consumer regret system into our law.Subsequently,on January 6,2017,the state administration for industry and commerce issued the “interim regulations for online goods to return in seven days for no reason” as a supplement to “consumer rights and interests protects the law”,At this point,the consumers' right of rescission is basically established in our country.In recent years,this right has also become a hot topic for consumers.As a member of consumers,the author is deeply interested in the consumers' right of rescission,and is very willing to contribute what he has learned to continue the construction of our country's regime of right.The author will explore and study the conception and legal nature of consumers' right of rescission from the academic level below,focuses on the relevant provisions of the consumer regain rights in Germany,Britain and Japan from four aspects: the history of development,the scope of application,applicable period and the legal consequences.separately put forward the scope of application,applicable period of the consumers' right of rescission in our country and the problems existing in protecting the operators,and then gives the solutions gives some suggestions from three aspects: changing the proof responsibility of the entity of online shopping,constructing mediation mechanism of consumer disputes in online shopping,and raising consumer awareness of rights protection,to achieve proper development,and handling of disputes.
