Investigation Report Endorsed By The Legislative Consultation

The legislative negotiation system is an important institutional creation for safeguarding democratic legislation and scientific legislation.It is an important form of socialist deliberative democracy and an important channel for ensuring that people exercise their legislative power through the national legislature.Since the Third Plenary Session of the 18th CPC Central Committee,the central government has repeatedly stressed the importance of legislative consultations.Local governments have been actively conducting legislative consultations under the central government's call.The theory and practice of legislative negotiation have achieved great development.The concept of legislative consultation has gradually become popular among the people.The public has given greater recognition to the legislative consultation,and has participated in the enthusiasm of participating in legislative consultation.However,there are no consensus views and basic provisions on some specific issues of legislative negotiation,such as the concepts,categories,leaders,and procedures of legislative consultations.This survey is a basic research.The purpose is to use research to understand the current status of China's current legislative consensus,and to explore the perfection of the legislative consultation mechanism on this basis.This survey involves the necessity of legislative consultation,willingness to negotiate for legislation,and the leader of legislative consultation.The approval scope of the legislative negotiation process and the scope of application and object of the legislative negotiation are also recognized.Through investigation,it was found that,first,there was a high degree of recognition of the need for legislative consultation;second,the enthusiasm for participation in the legislative consultation was high,but participation was generally low;and third,most respondents agreed that the process of legislative negotiation runs through all links,not an independent Fourth,the majority of respondents agree that the draft laws and regulations and all the important issues in the legislation should be negotiated,and all the legislation should have a low level of consensus.After analysis,it is found that the incompleteness of the legislative negotiation mechanism in China is an important reason that affects the development of China's legislative consultation.In order to improve our country' s legislative negotiation mechanism,we must first resolve the issue of unclear positioning of legislative consultations,and we recommend that legislative consultation be positioned as a legislative activity.Then we must determine the basic system of legislative consultation.Including the establishment of legislation-led principles;a clear legislative negotiation of the main body;set up an independent,specialized legislative consultation process;a clear legal consultation object and scope;consultation information disclosure;consultation feedback mechanism,etc.to make clear provisions.Through the formation of a sound legislative negotiation mechanism,it ensures the orderly conduct of legislative consultations.
