Research On The Phenomena Of Law Experts Participate In Legislative Activities

Recently, law experts in legislative activitise are noticed by more and more people. Law experts take part in legislation or affact on act by various modes. It's both the needs of improving legislation quality and the result of strengthening theoretics study. Developed under the efforts of letislation and experts, this system has grew up step by step. During this process, law experts's affections and advantages show fully, as a result, this phenomenon has been accepted widely in both practice and theory kingdom. However, everything has two sides, this phenomenon also has its own shortages, we must reflect how to avoid and resolve kinds of problems while recognizing its merit.This paper is doing research just follows the route of searching reasons, hackling actualities, analysing problems and making suggestions. Besides the preface, the article can be divided into three parts as follows :Chapter One: I defined two phrase's conceptions at first, they are"law experts"and"legislative activities". Then analysed the reasons that legislation and legislators need the help of law experts, revealed the practical needs and theoretical foundations of this phenomenon. Chapter Two: in this part, depended on plentiful material ,I described the situation of law experts participate in legislative activities in China, found out its developmental venation and generalized several modes of participation. In addition, I also analysed system foundations of this phenomenon by observing statistics.Chapter Three: on the foundation of above-mentioned description and analyses, I pointed out some problems that need to be noticed and avoided on three levels. Aimed at these problems, I then gave my notions and suggestions.Law experts participate in legislative activities involves many aspects, we must consider the phenomena comprehensively. How to utilize law experts's effects reasonably and fully is a question that need to be considered deeply.
