After amending of the Legislative Law,all cities divided into districts getting local legislation power.,but its legislative power is limited to three aspects:urban and rural construction and management,environmental protection and historical and cultural protection.However,its specific content are need to be further defined.At the same time,the practice of previous local legislation shows that legislation power of the cities divided into districts will face a lot of problems.In addition,the city as a separate level of the main body of legislation,how to separate the boundaries of the provincial legislative power should also be given full discussion of the problem.In this paper,author will discuss the legislative power of the city and the operation of the power,and give concrete and specific suggestions through the summary of the practical experience of the local legislation and the current new problems and new situations.This paper is divided into three parts:the first part,define the relevant concepts to limit the scope of the study,and support the background of the times through the elaboration of the development of local legislative power.The second part,on the basis of summarizing the practical experience of the previous local legislation,clarifies the problems existing in the local legislation and the municipal legislation of the district,and analyzes the causes of the problems.In the third part,according to the existing problems,the author puts forward some suggestions on improving the operation of the legislative power,including changing the concept of legislation,strengthening the operation of the norm,perfecting the legislative procedure and introducing the principle of subsidiarity.
