Study On Trade Facilitation System In The WTO Legal System

The Fourth WTO Ministerial Conference has officially launched the Doha round negotiations,and at this meeting,the WTO members agreed to make trade facilitation a formal negotiation.The Doha round was the first multilateral trade negotiation since the WTO was established.Since its opening,it has been stuck in a stalemate,and the issue of trade facilitation has been kept in a difficult position.The Agreement on Trade Facilitation is the savior of the Doha round and the first multilateral trade agreement since the WTO was established.After many difficulties,the Agreement on Trade Facilitation was adopted by the WTO general council in November 2014 and entered into force on 22 February 2017.The full text is divided into five parts:The first part introduces the research background,research significance,domestic and foreign research trends,research methods and innovations,and the framework and structure of the thesis.In the second part,I analyzes the overview of trade facilitation and then explains the background and history of trade facilitation.This part also discusses the content and structure of the Agreement on Trade Facilitation,the effective process and nature,and finally discusses the role and significance of the Agreement on Trade Facilitation.The nature of the Agreement on Trade Facilitation is that the Agreement on Trade Facilitation is a legally binding multilateral agreement,the Agreement on Trade Facilitation is an important part of the Doha trade negotiations package and the Agreement on Trade Facilitation is an important part of the WTO legal system.The Agreement on Trade Facilitation has the role of enhancing trade transparency,promoting the modernization of customs administration and promoting trade development among members of developing countries.The third part,through comparison with articles 5,8 and 10 of the GATT 1994,is based on the provisions of articles 1 to 12 of the Agreement on Trade Facilitation to explain the transparency principles of the WTO,to discuss the fees and charges on importation and exportation,formalities and documentation on importation and exportation and clearance of goods,to improve the freedom of transit d from the two aspects:the negative obligations and the positive obligations.In the fourth part,the latest features of the Agreement on Trade Facilitation is embodied,which stipulates special and differential treatment for members of developing countries and members of the least developed countries.The content which is operable specified in this section is detailed and specific,and it has rigorous logic and complete structure.The section has improved the special and differential treatment provisions.The provisions of capacity-building assistance and support in this section will enhance the capacity of developing country members to implement the Agreement on Trade Facilitation.The fifth part expounds the two premises of the implementation of the Agreement on Trade Facilitation:the Reservation and Explanation of the agreement,analyzes the concrete practice of China,as A WTO developing country member,implementing the class A and class B measures of the Agreement on Trade Facilitation,summed up the A Single Window system implemented by the China(Shanghai)Free Trade Area.The"One Belt and One Road" initiative provides theoretical guidance and direction for the Agreement on Trade Facilitation,points out the path for the implementation of the agreement,namely parallel implementation and international cooperation.To sum up,in the context of the Agreement on trade facilitation in effect,this paper attempts to make comprehensive interpretations of the production process of the issues of trade facilitation,the entry-into-force and nature of the Agreement on Trade Facilitation,trade facilitation measures,special and differential treatment provisions and the implementation of the Agreement on Trade Facilitation in China,in order to have a profound understanding of the customs clearance systems and the principle of special and differential treatment,and even the international trade facilitation system.
