Study On Legal Protection Of Patients' Right To Health

Relevant judicial explanations on medical disputes have been promulgated by our country in 2017,making doctor-patient relationship become a hotspot issue again.Besides,recent years have witnessed the increasing incidence of medical disputes and frequent occurrence of violence against medical staff though the gradually standardized laws and regulations.Of particular note,the NPC and CPPCC were held at a very crucial time of the social transformation,embracing both the golden period of development and a high contradiction phase.All kinds of social contradictions,such as the overwhelming national institutions,advanced economic system,altered social framework,adjusted interest structure and transformed ideas are becoming increasingly obvious.Those indicate an urgently need for a law to safeguard and guarantee people's health.Therefore,it is quite essential to research on the patients' right to health.This paper,firstly,based on the concept of the right to health,gradually introduces the concept of patients' right to health by three cases of violating patients' right to health in medical practice.Moreover,relevant theory of patients' right to health is discussed in view of the doctor-patient relationship,and then the core of patients' right to health can be concluded.On this basis,the paper analyses the legal ties of patients' right to health and points out the subject,object,content and property of patients' right to health.Those are given a detailed discussion.Then,this paper analyses problems encountered by our country in the region of patients' right to health.Based on the international convention,international documents and regulations on the right to health as well as the relevant theory researches at home and abroad,the paper learns from the foreign practical experiences and then puts forward the constructive opinions to protect and relieve the patients' right to health.This paper focuses on the conflicts between patients' right to health and other rights.Besides,a variety of problems existing in the field are also mentioned.Finally,this paper explores methods to safeguard patients' right to health and to perfect medical security system as well as to improve the protection system of patients' right,perfecting legislation,building of the right to health in patients and health conflict resolution mechanism,optimize the patients health relief system,through these three aspects to improve the patients' rights protection mechanism,and puts forward specific proposals,which contribute to a better protection of patients' right to health.
