Analyses The Public Participation In Local Legislation

Since the reform and opening up,China's economic development and political democracy,the public political participation requirements are also gradually strong,and because of the interests of society more and more differentiation,social contradictions become more and more complex,and the legislation needs to balance various interests,handle various social contradictions,which makes all aspects of society in our country are actively public participation.This paper is divided into five parts.The first part is the empirical study of the public participation of Qingdao municipal government's garbage classification legislation in Shandong Province,and draws a general reason for the low level of public participation in local legislation,and finds out the causes of this problem.The second part analyzes the theoretical basis and legal basis of public participation in local legislation from the perspective of people's democratic sovereignty theory,public participation democracy theory,governance theory and new public management theory.The third part mainly introduces the achievements and problems of public participation in local legislation in recent years,and the reasons for the problems.The fourth part mainly analyzes the countries with relatively mature constitutional system in the world,the mechanism of local legislative participation in the United States and Japan.The fifth part is the core part of this paper,mainly exploring the effective ways to improve the local legislation of public participation in our country: one is the public participation in local legislation to have a support system;the two is to raise public awareness and ability to participate in local legislation;the three is to improve the methods and procedures of the public participating in local legislation;four is the establishment of supporting to perfect the mechanism of public participation in local legislation.Public participation in local legislation is not only the most basic human rights granted by citizens to the constitution,but also an effective way to protect a country's local legislation closer to public opinion,protect citizens' right to know and resolve various social contradictions.
