On Anti-corruption Legal System Of Japanese Special Corporations

Controlling corruption in state-owned enterprises is an important part of China's anti-corruption construction,and is also an urgent demand for the healthy development of China's economy.The special corporation is the important form of the Japanese state-owned enterprise,which is funded by the government and bears a certain public service function,like the state-owned enterprises in China,it faces the dual risks of public power corruption and private sector corruption,and the serious corruption problems have appeared at the end of the last century.To solve the problem of corruption of special Corporation,Japan adopted corresponding measures in the reform of the early twenty-first Century,established and perfected the Anti-corruption legal system of Japanese Special Corporation.Based on the similar corruption risks faced by Special Corporation and state-owned enterprises in China,The construction experience and achievements of Japan's anti-corruption legal system of Special Corporation should be used for reference in our country.This paper focuses on the study of the anti-corruption legal system of Special Corporation from the three aspects of prevention,punishment and supervision,and studies how to establish and improve the anti-corruption legal system of Special Corporation according to the related corruptions.Although there are no special laws against Special Corporation's corruption in Japan,there are many related anti-corruption legal systems.Prevention: to solve the problem of corruption caused by Amakudari,strengthened supervision over civil servants and formulated a system to prevent conflicts of interest.To solve the problem of collusion bidding,the system of public procurement for Special Corporation has been perfected.They also formulated a special corporate information disclosure system to prevent corruption.Punishment: with a rigorous system of criminal law,and an independent and efficient procuratorial organ punishes the crime of corruption.Supervision: through the corresponding legal system to ensure the effective operation of the diversified supervision system,the government departments,the audit institutions,the administrative evaluati on Bureau and the public of the special legal persons become the backbone of the anti-corruption.In short,Japan's solution to the problem of corruption of Special Corporation is based on the improvement of relevant legal system and the coordination and c ooperation of the system.China should combine the specific situation of the state-owned enterprises,learning from Japan's achievements and experience in system building,to control the corruption of state-owned enterprises in China.
