| The ’Outline Plan for the Comprehensive Building of a System for Fighting and Preventing Corruption Balancing the Priorities of Education,Systems and Supervision’ of the CPC central committee states clearly that to set up and perfect the punishment and prevention system against corruption is the most important decision made by the CPC to combat corruption and uphold integrity facing the new situation.The CPC has experienced the process of deepening the understanding of governing laws and the work of combating corruption and upholding integrity since she was in power.The ability of punishing those who commit corruption shows directly the governance capability of a party,it is also a sign of powerful governance capability for a party to prevent corruption.Facing with the new historical circumstance,the Party Central Committee has put forward a series of important tactical guiding principles and ideas concerning combating corruption and upholding integrity,which form the important thought of governance guidance and probity construction.General secretary Hu Jingtao emphasized in the seventh plenary session of The Communist Party of China seventeenth session of the Central Commission for Discipline Inspection:"the work of probity construction and anti-corruption should follow the guidance of’Deng Xiaoping Theory’and ’the Three Important Thought’,thoroughly implementing the Scientific Outlook on Development,and stick to the policy of improving the phenomenon,solving the essential problem,emphasizing on precautions,comprehensive governance of both punishments and preventions,strict the discipline of the party,strengthen the party work style construction,promoting the system of punishing and preventing of probity and to solve the prominent problems that the people concerned most in the process of anticorruption construction." Currently,our government is facing the condition of market economy and the opening up policy,it is an important action for the government to improve the ability of governance and to consolidate the governing position through perfecting a series of principles,systems and measures,also to vigorously explore the system of anticorruption that correspond to the market economy system,it is also the vehicle and means of implementing the law of governance and anticorruption.State-owned enterprises are the leading force of public owned economy and the important pillars of state economy,the bases of the party governance,the driving force of the socialism with Chinese characteristics.Corruption in state-owned economy are spreading,the amount of money concerned is rising constantly,all these phenomenon decreased the state-owned assets,damaged the probity of national public services and also severely damaged the image of the party in power.Thus,the basic means to tackle the problem of corruption in state-owned cooperation is to find out a mechanism and management system that correspond to our current state conditions and effective means in preventing and punishing corruption in the organization,mechanism and measure aspects.As a student of 2009 EMBA in SWUFE,the author has been working in the field of anticorruption for more than a decade,the author of this paper dedicates his working experiences in this paper which is called "the contemplation on punishing and preventing corruption system construction".In writing this paper,the author was carrying out the anticorruption measure of the state and the requirement of the’Outline Plan for the Comprehensive Building of a System for Fighting and Preventing Corruption Balancing the Priorities of Education,Systems and Supervision’,to utilize the knowledge learned in class in practice,to find out an effective way to regulate the management methods of the state-owned corporations,it is of profound and lasting significance in our time and in practice.This paper can be divided into four chapters.The introduction part,the first chapter of this paper,is composed of four sections,overviewing four aspects of the purpose and significance of constructing a punishment and prevention system against corruption in state-owned enterprises,research methods,the relationship between this paper and the author’ s learning experience,and the innovation and drawbacks of this paper respectively.The second chapter is about the paper’ s theoretical basis and literature review.It contains three sections,which are the conception of curruption,the essential cause of corruption and a literature review of studies on domestic punishment and prevention system against curruption respectively.Chapter three analyzes the status quo and forms of curruption in state-owned enterprises.This chapter is divided into three sections.Some typical shocking cases of corruption in state-owned enterprises of our country are listed in this chapter,revealing the status quo of corruption in present state-owned enterprises.After that,nine main forms of enterprise corruption are summed up.It also analyzes the causes of state-owned enterprise corruption,laying the groundwork of chapter four.As the most important and most essential part of this paper,chapter four proposes some measures and suggestions on constructing a punishment and prevention system against corruption in state-owned enterprises.Chapter four consists of two sections.The first section demonstrates the necessity of constructing a punishment and prevention system against corruption in state-owned enterprises and the second section proposes suggestions on how to construct a punishment and prevention system against corruption in state-owned enterprises effectively,comprehensively and systematically from six perspectives,which are insisting combatting curruption and upholding integrity and clarifying the guiding ideology,building an education system based on morality,building an institutional system based on legislation,building an administration system based on law enforcement,building a power execution system and building a leadership mechanism system emphasizing on supervision for constructing a punishment and prevention system against corruption in state-owned enterprises respectively.The last part is annotation and reference.On November 25th,2010,S AS AC of the State Council held a conference on constructing a punishment and prevention system against corruption in state-owned enterprises.Mr.Jia Fuxing,the SASAC of the State Council CPC member and discipline inspection commission secretary,emphasized that in order to maintain the development of state-owned enterprises,several measures need to be taken.The punishment and prevention system against corruption should be embodied in the enterprise management system,and combatting corruption and upholding integriry should be embodied in the management and administration process.It needs to be taken into consideration together with other improtant issues of the enterprise like development strategies,production and operation,interior management and risk management.Therefore,what this paper studies is in accordance with the chanllenge that the state-owned enterprises are confronted with.This paper is aimed to shed some light on offering some feasible measures of constructing a punishment and prevention system against corruption.It is hoped that some suggestions from this paper can be taken by relevant governet,offices and state-owned enterprises.The innovation of this paper is that the enterprises it chooses are typical and the characteristics of state-owned enterprises are clearly analyzed,leading to the objectivity,feasibility and availability of the measures and suggestions proposed by this paper.Without doubt,the conception and prediction of constructing such a system is an exploration and trial.The effect may vary according to different industries,systems,administraters and environments.Therefore,it takes some time to prove the conception.The punishment and prevention system against corruption proposed by this paper may not be suitable to all state-owned enterprises.Further researches and discussions need to be taken for the sake of improving and completing this system. |
