Research On The Yangtze River Water Environmental Pollution Crime Investigation

The Yangtze river economic belt development faces many difficulties and problems to be solved,of which the severe situation of ecological environment comes first.The primary task of the protection of the Yangtze river is ecological protection.The focus of ecological protection is on water pollution control,and water pollution control needs to take a firm blow to all kinds of environmental pollution and crime in the basin.Therefore,this paper is entitled the research on Yangtze river water environmental pollution crime investigation,aims to analysis the present illegal and criminal behaviors in the waters of the Yangtze river,grasp the characteristics of crime,seize the difficult points and carry out the law enforcement and judicial activities on such cases.Only through the joint efforts of law enforcement and judicial departments,is there a possibility to effectively curb Yangtze river water environmental pollution crime,effectively do a good job of protection and renovation of the Yangtze river water,promote the ecological environment protection and restoration of the Yangtze river.In this way,a picture of clear water and castle peak can be realized,in turn to build the Yangtze river economic belt,construct beautiful China.Body of this paper totally have about 45,000 words and can be divided into four parts.They are respectively the Yangtze river water pollution of the environment crime overview,causes,investigation difficulties,and the idea of investigation.The first part is an overview of environmental pollution crimes in the Yangtze river.This part firstly defines the pollution crime of the Yangtze river.Secondly,the paper indicates the characteristics of environmental pollution crime in the Yangtze river from the perspective of time and space,quantity,means and investigation.Thirdly,this paper analyzes the four main causes of environmental pollution crime in the Yangtze river,as shown by the concept of ecological sustainable development not fully implemented,the imbalance of regional development,the inadequate crime strike,the difficulties of pollution harmless treatment.Finally,this paper discusses the specific harm caused by crime from four aspects:damaging the ecological environment,threatening life and health,impeding economic development,influencing the navigation safety.The second part discusses the difficulties in the investigation of environmental pollution crimes in the Yangtze river from four aspects.Firstly,the source of the environmental pollution cases is narrow and the channels are not smooth;Secondly,the current environmental protection administrative law enforcement and criminal judicial cohesion mechanism are not sound;Thirdly,the investigation of environmental pollution cases has jurisdiction over overlapping,conflicts and disputes between regions and levels of jurisdiction;Finally,there are difficulties in the investigation and forensics,which includes five aspects:investigation main body,investigation evidence,administrative law enforcement evidence conversion application,crime detection collaboration and pollution damage causality identification.The third part puts forward the idea of the investigation aiming at the causes of the environmental pollution crime in the Yangtze river and the difficulty in the investigation of the crime.The first is that increasing the support for investigation work through legislation and criminal policy.The second is to broaden the channel of the source through the reward mechanism,early warning mechanism,cooperative mechanism and so on.The third is to improve the mechanism of environmental administrative law enforcement and criminal justice cohesion through the implementation through administrative law enforcement and criminal justice,intensifying the supervision of the procuratorial organs to the reduced cohesion and exploring the connection modes between penalties for public security administration and criminal prosecution.The fourth is coordinating the conflict of jurisdiction to realize the criminal justice of dynamic environment by establishing the principle of active jurisdiction and "relative"jurisdiction,comprehensively and flexibly applying various jurisdictional principles.The fifth is to improve the investigation and forensics ability of environmental pollution cases through strengthening the construction of investigative subject and equipment,establishing the standard of evidence for environmental pollution cases,building public prosecution guiding investigation mode,exploring new methods of evidence collection and establishing perfect environmental pollution damage identification system.
