The harmony and stability of labor relations is an important part of the overall social harmony and stability.Labor disputes are disputes between laborers and employers in the process of employment,which to a certain extent reflect the status of labor relations.In the long-term game between laborers and employers,laborers have always been in a weak position.However,with the introduction of a series of laws and regulations by the state and the continuous establishment and improvement of related systems to protect the legitimate rights and interests of workers,This situation has been reversed to some extent,Laborers have greater initiative in the process of fighting for their rights.At the same time,China's economy has entered the new normal,Labor relations are increasingly complex and changeable.This article analyzes and studies the labor arbitration cases handled by the labor dispute arbitration agency in Z city of Henan Province from 2012 to 2016.In the new normal of economy,the country's economic structure has undergone deep adjustments,especially since the supply-side reforms.Labor disputes present new features in the subject of the dispute,the object of the dispute,the way in which the dispute is handled,and the outcome of the dispute.The controversial workers are showing new features in terms of gender,household registration,length of service,and the conditions of the lawyer.The disputes are still concentrated on social insurance,wages,and economic compensation.The way in which the government handles labor disputes is also changing.The contradiction between labor disputes by labor arbitration agencies has continued to intensify,and the mediation rate of labor disputes has declined.Based on the empirical research on the new characteristics of labor disputes in the economic transition period,the author has analyzed the factors that influence he development of labor disputes from four aspects of economy,society,law,and government by referring to a large number of documents and combining his own long-term experience in handling labor disputes.The ongoing supply-side reforms in China have also had a profound impact on labor disputes.Some backward production capacity has been eliminated.Controversies such as the arrears of wages and employee relocations caused by the suspension of production conversions have increased substantially.In terms of social factors,during the construction of China's social security system,enterprises have assumed important responsibilities,virtually increasingthe burden on enterprises.Some companies have shirked their legal responsibilities,and illegal operations have directly contributed to the increase in social insurance disputes.The development of information technology has reduced the cost of labor rights protection.The introduction of labor laws and regulations affects the development and treatment of labor disputes.The change of the concept of government governance,the change of government functions and the improvement of administrative efficiency also affect the laborers' passion for rights protection and the handling of labor disputes.In the face of the ever-increasing number of complex labor disputes,The first is to strengthen self-building.Strengthen the team building,including training of talents,training of business skills,education on honesty and self-discipline,reasonable pay and promotion channels.Strengthen the informatization construction of labor disputes,use the online platform to improve the efficiency of case handling and the quality of case handling,and reduce the costs for laborers to maintain legitimate rights and interests through dispute resolution through arbitration.The second is to strengthen the propaganda and education of labor laws and regulations,especially the cultivation of enterprises' awareness of business operations in accordance with the law,and to monitor key enterprises with multiple disputes.The third is to establish and cultivate grassroots mediation organizations and establish tripartite coordination mechanisms among employees,enterprises,and labor unions.The fourth is to integrate the national administrative resources and the departments coordinate and coordinate with each other.
