With the development of science and technology,the Internet has become an emerging medium with its rapid spread and wide range.The Internet makes information more rapid and people communicate more easily.Accompanied by the emergence of Internet shopping,many advertisements propagated through the network,the universality of network users to make a lot of false advertising into people's horizons,network makes the consumers' rights and interests can not get protection,false advertisement market competition order maintenance.Therefore,it is necessary to strengthen the relevant laws and regulations on the emerging phenomenon of false advertisement.The main basis for the management of the network advertisement "advertisement law","interim measures for online advertising management","consumer rights and interests protects a law","anti-unfair competition law","food safety",etc.The main norms of these laws cannot solve the traditional advertising problem,and there is lag.This paper analyzes the present situation of the network false advertising current law regulation,the basic experience of other countries for reference,an in-depth study,put forward reasonable Suggestions for perfect the system of network false advertisement in our country,thus protecting the legal rights and interests of consumers,maintain a good market order.This article is divided into four parts,the first part of writing network overview of false advertisement,including the network of false advertising concepts,characteristics,the necessity of legal regulation,including key network characteristics are: from the traditional advertising false advertisement that difficult,strong concealment,wide range,etc.At the same time,this chapter also describes the necessity of network false advertisement from two aspects: protecting the legal rights of consumers and maintaining market competition order.The second part analyzes the current situation and existing problems of the legal regulation of online false advertising in China.At present,the law of false advertisement in China is not perfect,and the legislation is hysteresis.Mainly in the network of false advertising regulation in China three problems: the network false advertisement definition is not clear,the network of false advertising law responsibility is not clear,the network advertising regulatory system is not perfect.The third part introduces the legislation and evaluation of the legal regulation of online false advertising in foreign countries,including the legislative experience of the United States,Germany,Britain and France,and the evaluation of these experiences.The fourth part,through the consult literature material,comparison analysis method,improve the network of false advertising law regulation Suggestions,including: a clear definition of the concept of network of false advertising,define the legal liability of false advertising network,perfect the supervision system of online advertising.
