Research On The Administrative Law Regulation Of Information Tools

In recent years,China is in a period of rapid social development.Due to the rapid development of the economy,numerous and complicated social phenomena have emerged as the times require.Right of government regulation is used more and more in all fields of society,but because of the contradiction between government departments responsible for broad responsibilities and limited law enforcement resources,the traditional regulation tools has been unable to deal well.The quality of public regulation is directly determined by the matching degree of the regulation tool and the regulation goal.Government relevant departments should improve the quality of regulation in order to achieve the desired regulatory objectives and explore a new kind of regulatory tool----information tools.Because of the rapid development of the Internet,the speed of information dissemination is fast and wide,in addition,the characteristics of information tools are the result of "low cost to high efficiency",information tools are more and more admired and trusted by the government relevant departments.In our country,the application of information to the government relevant departments is mainly applied in the fields of food safety,environmental protection,safety production and product quality,the main means or forms are the implementation of the administrative blacklist system,the publication of the illegal facts,the reputation penalty,the joint punishment of dishonesty and so on.In view of the increasing frequency of the use of information tools by the government relevant departments,a series of problems have been caused in practice.At present,the research on information tools is getting deeper and deeper in the academic circles,but most of them are about food safety,environmental protection and financial supervision and so on.More research is to advocate the use of information regulation tools,and few studies the supervise issues,procedural matters,responsibilities issues in the process of information tools.This article through the summary of the information tools,the legal text,the system practice analysis,let the reader have a full understanding of the information tools used by the government relevant departments.Through the extension of "shame culture",the deterrence of "reputation mechanism" and the support of "soft law theory",we find astrong theoretical foundation for the effective mechanism of information tools from the aspects of society,economy and law.Summarize the limitation of the principles of administrative law to the application of information tools,and finally improve our related system of information tools,so as to find a set of institutional framework for its own.
