China is one of the countries with a high degree of population aging in the world.The population of the elderly is large,and the whole society has a great demand for the service industry of the aged.With the improvement of the old people's demands for the quality of life,the general care model of the aged can not meet the needs of the modern people,and has brought serious challenges to the current mode of the old age.The State Council issued a number of suggestions on accelerating the development of old-age service industry and the guidance on the combination of medical and health care and old-age service,which explicitly requires the development of medical care and other old-age services,and the integration of medical care in the old-age mode arises at the historic moment.It is necessary to sign contract for the aged service in the pension institutions.There is no relevant provision in our current contract law.At present,people are not very aware of the new integration of medical care and integration services,and the elderly,as a weak group,are in a weak position in the age,economy and themselves.The legal research of the medical and integrated pension service contract has become particularly important.The current research on medical integration is mostly focused on Sociology and management,and less literature and data on legal research.This article is intended to introduce the concept,nature,rights and obligations of the integrated pension service contract and the liability for breach of contract from the perspective of the integration of medical care and integration services from the perspective of the integration of medical care and integration.Through a large number of collation and collation of the court's judicial documents,this paper summarizes the disputes arising from such standard contracts and analyzes the possible types of disputes.In view of the problems and shortcomings,we put forward some ideas and suggestions for improving the contract in the end,hoping to be beneficial to the judicial practice in the future.
