Research On Guarantee Of Farmers' Land Property Right In China Under New Situation

The survival and development of human individuals cannot be separated from the supply of resources.Land is not only a supply of human survival needs,but also an important dependency of the farmers' right to subsistence and development.Rural land is not only an important material source for farmers,but also the object of farmers' land property rights.As an agricultural and populous country,the issue of peasants cannot be ignored.It is an important prerequisite for the stable development of the society.Therefore,exploring and securing the land property rights of the peasants is a meaningful practice that is both realistic and developmental.As for the peasants problem,under the new situation,the focus is to protect farmers' rights in land.This is not only the need to govern the country according to law,but also the connotation of protecting citizens' basic human rights in the Constitution.The peasant land property rights have the constitutional and civil law property rights nature.The development of rural economy and agricultural industry cannot be separated from the circulation of rural land.The main reason for the transfer of agricultural land is to increase the income of farmers and realize this goal.It is necessary to first determine the dominant position of farmers in rural land circulation and define the boundaries between ownership and use rights.At the same time promote the development of land property rights.By analyzing the situation in the development of rural land circulation in the context of the existing system,as well as the deficiencies of farmer property ownership status and the loss of peasant beneficiary rights,the causes of damage to peasants' land property rights are analyzed.It proposes a feasible way to reconstruct the peasants' land property rights security system.
