With the development of economy, there are more and more Indian citizens who are employed overseas and the damage of the rights of foreign workers is becoming increasingly prominent. In face of this outstanding issue, the Indian government has promulgated the "Immigration Act 1983" and "Immigration Rules",which established the basic framework for protecting foreign workers. The outstanding advantages of the bill are the clear identification of special agencies for the protection of the rights of foreign workers, and forming comprehensive supervision measures for intermediaries, employment agencies, and outbound employment.Meanwhile, the appeal system, the reporting system of the embassies and consulates, and the hearing system are applied to provide adequate relief for the disabled migrant workers. At the same time,in order to remedy the problems in legislation,India has continuously optimized the government service system in practice, and provided special welfare funds and mandatory insurance systems for overseas workers, which greatly improved the anti-risk capabilities of overseas workers. And the government of India is strengthening the bilateral and multilateral negotiations with major labor importing countries, which greatly contributing to better protect the overseas workers. However, there are still many problems concerning protecting the rights of migrant workers abroad, such as inadequate legal system, unscientific management system, and inadequate services provided by the government. Therefore,China can learn from India's experience, making progress in protecting the rights of migrant workers abroad to provide all-round protection for the rights of foreign workers in China.Firstly,we can introduce special laws for protecting the rights of foreign workers.Secondly, improving the cooperation between the departments and improving government services.Thirdly, perfecting the remedy mechanism for the rights of foreign workers. At the last, strengthening the cooperation with international organizations and labor receiving countries.
