Study On The Administrative Law Of China's Trial Statutory Agency

The statutory agencies emerged in the new public management movement in the early1980 s.They have been widely applied in the United Kingdom,the United States,Singapore,and Hong Kong,and have played an important role in the public administration of these countries and regions.In recent years,statutory agencies have gradually been promoted and tested in China.In the process of economic developments and deepening reforms in our country,the introduction of statutory institutions was proposed.A new type of social governance model is considered mature in advancing the construction of free trade trial zones.With the transformation of government functions,the reform of major departments,and the continued strengthening of institutional reforms,China's existing social governance structure must change with the times.Judging from the practice of social development,both the government and the enterprise have their own limitations and cannot provide all management and services for market development.The society needs independent,autonomous,flexible and efficient public organizations to undertake part of the public affairs and solve problems for the government to solve social problems.In this sense,the emergence of statutory agencieshas great practical feasibility and important practical significance.The establishment of the Guangdong Qianhai Administration Bureau is the first trial of the statutory institution's first pilot reform in China.This paper summarizes the pilot experience of Qianhai Administration Bureau by comprehensively reviewing the background,development history and typical patterns of the statutory bodies.The study found that the statutory institution's new organizational form and mode of operation are unique in value compared to the government and its functional departments,institutions,and other social organizations,which are legally established,legally mandated,and open and transparent.It is determined that statutory institutions are set up according to specific laws,regulations or rules,and undertake public affairs management functions or public service functions according to law,and are not included in the sequence of administrative agencies.They are public agencies with independent legal person status.It is clear that the statutory agency's independent administrative subject status in China is different from that of the government and institutions.It opens a new path for the reform of the administrative agency in our country,and provides a new direction for the development ofChina's major system reform and public institution reform.It is worth learning for the government to improve public management and public services.
