The undercover interview,a form of interview that emerged in the 1990 s,has been undergoing a series of changes from the cautious use at the beginning to currently the hottest interviews in the news industry.Undercover interview mainly refers to the use of covert methods as a means of news gathering,which provides distinctive advantages of access to news materials that are not accessible through conventional means of interviews.The information acquired through this method is often closer to the truth of the facts and thus is of great value and is very popular among the public.Therefore,the undercover interview gradually becomes an interview method widely used by the news media.As an effective means of supervision in all spheres of society,it plays an important role in safeguarding the public's right to know and the public interest.However,the undercover interview still lack reasonable legal regulations,thus resulting in legal problems that infringe the publicity rights of respondents,triggering a series of press infringement litigation and even social credit crisis.At present,China finds itself in the era of information explosion.The information obtained through undercover interviews can be disseminated to all parts of the country within a short period of time on the Internet.This has a great impact on the publicity rights of respondents.Therefore,the rationality and necessity of using undercover interviews is extremely important.Therefore,starting from the nature of undercover interview,this paper uses the hypothesis model and cost-benefit model of economic person in economic analysis to analyze the rationality and validity of undercover interview.In terms of mining the truth,the undercover interview has a huge economic superiority compared with the ordinary interview,and thus become the rational choice of every economic person.This is the rationality of the recessive interview.However,the necessity lies in the frequent cases of tacitly interviewing infringement,but the recessive interviewing behavior lacks effective legal regulation,and the court has no clear legal basis for the cases of tacitly interviewing infringement.With the gradual progress of governing the country according to law and thepromulgation of the "General Provisions of the Civil Law of the People's Republic of China," the new environment has been provided for the inclusion of undercover interviews in the legal system and relevant law has been established to safeguard the rights of respondents,the media and the public.Therefore,judging from the general legislative environment of our country,it is the time for legal regulation of undercover interviews to be established.Therefore,through the case study of undercover interviews,this paper studies the changes in attitudes and ways of handling attitudes toward this behavior since the emergence of recessive interviews and analyzes the extent of their damage to the publicity rights of respondents.From the media and interviewees perspective,effective ways to regulate recessive interviews will also be discussed.
