Under the current international and public opinion,the attention of the international community is gradually focused on the impact of China on natural resources and ecological environment in the process of the construction of the South China Sea islands and reefs.The first part is an overview of the legal protection of the construction of islands and reefs in the South China Sea.Therefore,the legitimacy of the construction of the islands and reefs in the South China Sea is reflected.Secondly,through the classification of the environmental problems of the islands and reefs in the South China Sea,the present situation and deficiencies of the construction environment of the islands and reefs in the South China Sea are comprehensively understood.The importance and necessity of the legal mechanism of environmental protection in the construction of islands and reefs in the South China Sea.The international environmental obligations of improving the legal mechanism of environmental protection for the construction of islands and reefs in China are not clear.The environmental protection mechanism is backward and so on protection mechanism.The second part is the analysis of the international legal obligations of environmental protection in the construction of islands and reefs.This chapter combs the environmental protection obligations of the United Nations Convention on the Law of the Sea,the Convention on Biological Diversity and other international treaties.China needs clear international environmental protection obligations in the construction of South China Sea islands and reefs.The third part is the reference of the environmental legal protection machine for the island and reef construction.This chapter analyzes the experience of the legal protection mechanism of the island and reef construction in the United States,Japan and South Korea,respectively.The management organization of the environmental legal protection mechanism in Korea is reasonable.Clear structure.The United States and Japan environmental legal protection mechanism legislation is adequate,the classification is clear,the management is orderly.The fourth part is to improve our country's construction of legal protection mechanism of the South China Sea and the environment.In this chapter,"the United Nations Convention on the law of the sea" and other relevant international marine environmental protection law as a guide,in order to achhieve the construction of South China Sea Islands International Environmental protection obligations as the goal,improve the comprehensive construction of environmental legal protection mechanism.And improve the legal protection of the environment construction of South China Sea Islands the mechanism of the need to further improve the construction of environmental prevention mechanism of South China Sea Islands,South China Sea Islands construction of environmental legal safeguard mechanism,the South China sea and the construction of environmental remediation measures.The emergency mechanism construction of the South China Sea Islands environment prevention mechanism mainly in the South China Sea Islands construction environment routine early warning mechanism and the South China Sea Islands construction as the main form of environmental emergencies;South China Sea reefs construction environmental preservation mechanism from the South China Sea the construction of environmental protection mechanism of ship Island,South China Sea Islands construction environmental management mechanism,The regional cooperation mechanism of the South China Sea island reef construction environment is further improved.The three interdependence and mutual promotion are mutually beneficial.
