The Legal Regulation And Crisis Management Of The Overlapping Of Air Defense Identification Zones

As a new kind of Airborne Early Warning Mechanism,Air Defense Identification Zones(ADIZ)has already built up several State practice foundation as well as international law theoretical basis.However,international unified regulation of ADIZ still lacked now because of the in-coordination among different National wills and interests.The overlapping of ADIZ is one of the new challenges that appeared in the application of ADIZ,which has brought much threaten to the related areas' security.International society had little experience dealing with this problem before,neither in legal regulation nor crisis management.It is no doubt that an efficient solution to the overlapping of ADIZ will make much sense both in promoting the development of ADIZ and maintaining the security of related areas.The main purpose of this article is proposing solutions from the perspectives of the construction of legal regulation and crisis management.This article is divided into four parts:the first part introduces general situation of the overlapping of ADIZ,such as its intention,causes,definition and features;the second part is about the construction imagination of legal regulation in the overlapping of ADIZ,which was on the basis of legitimacy discussion;the third part is the imagination of crisis management of the overlapping of ADIZ,which references similar mechanisms before;the last part of this article is the suggestion to the overlapping of ADIZ among China,Japan and South Korea,both in legal regulation and crisis management,which combine the advice in the second and the third part of this article.With the increase of the number of ADIZ countries,the overlapping of ADIZ will be more noticeable and more complicated.Related countries should try to reach consents in legal regulation and crisis management to help push forward the issue.
