| Since China announced the establishment of the East China Sea Air Defense Identification Zone, whether in civil society or the international community, Air Defense Identification Zone(ADIZ) have attracted much attention. The imagination of the ADIZ was proposed by the United States during World War II, and in 1950 put into practice by the United States, established the world’s first ADIZ. So far, more than 20 countries and regions set up ADIZ, these practices provide a large number of samples for our theoretical research. This article, based on the existing theoretical research results, with the integrated use of literature research, comparative analysis, analogy analysis and other research methods, combined with the existing practice of States in the ADIZ, to explore the way to build legal mechanism of the ADIZ from the angle of domestic law and international law.This article is divided into four parts: The first part is to give a comprehensive introduction to ADIZ, including the definitions, characteristics, system values of ADIZ, and the differences with other relevant international law concept; the second part is based on the introduction of the emergence and development of ADIZ, compare the different point of views in academic ADIZ, and analyze the existing problems in the practice of ADIZ; the third part is by seeking for the legal basis of ADIZ, to clear the rights, obligations and the applicable principles of international law in the ADIZ, then explore the legal status of ADIZ; the fourth part analyzes the standpoint and practice of China and try to build the domestic legal mechanism and international legal mechanism of ADIZ. Each chapter aims to clarify the facts, discover the problems and find the solutions, point out the current problems in the practice of ADIZ, respectively, from the standpoint of both domestic and international, make a meaningful exploration to build the legal mechanism of ADIZ. |
