Since America's announcement of an ADIZ in 1950,more than 20 states and regions have maintained air defense identification zones in the neighboring airspace outside their territories in the last 67 years.However,China's similar announcement of an ADIZ in the East China Sea in November of 2013,elicited strong protests from the international community.This present paper tries to identify the relationship between the rights of the coastal countries' establishment of ADIZs and the overflight freedoms of all aircrafts in international airspace.The dissertation is divided into five parts,the first part briefly introduces the history of ADIZ and describes its definition and characteristics;the second part explores why coastal countries can make such announcements beyond the scope of territorial airspace from the perspective of both international law and domestic law,the author concludes that the establishment of an ADIZ is based on the right of natural law;the third part analyzes the practices and regulations of some states in their ADIZs and concludes that CHADIZ does not differ markedly with those of other ADIZs,and it deserves respect from other countries;the fourth part points out the systematic value of ADIZ and focuses on the complex situation in East Asia.In the concluding remarks,the author suggests China could enhance the relevant practice towards the direction of international customs or even treaties and increase its air defense early warning ability by making full use of the ADIZ mechanism.
