ADIZ(air defense identification zone)means an area of airspace over land or water in which the ready identification, location, and control of aircraft is required in the interests of national security. America is the first country which has established the first ADIZ in 1950. Following America, till today, more than 20 countries, including China in 2013, have established their owned ADIZs. The countries’ unilateral established ADIZs range and regulations have deeply influenced the convenience and security of aviation, even the national’s relations. ADIZ is so important. However, there is no any international law on it. There come the questions. Is ADIZ legal or what are its legal bases based on international law? What is ADIZ’s flaws and how to improve it? For the questions above, the dissertation analyses the different ADIZ from the perspective between China and America by using many research methods. At last, the dissertation comes up with ADIZ’s legal bases and improvements with the hope of making ADIZ system exist and develop under the international law, in order to ensure the convenience and security of aviation.
