| Decision of the CPC Central Committee on Major Issues Pertaining to Comprehensively Promoting the Rule of Law which symbolized power list system launched officially was passed in the Third Plenary Session of the 18th Central Committee of the CPC.This file designated that governments at all levels and their departments should execut this system and make procedure of exercising administrative power known to the public specifically.Guidance on the implementation of the power list system of local government departments at various levels in which put forward several specific requirements about goals,implementation scope,primary mission,organization and implementation has been issued by the Central Committee in March 2015.It is full of significance to implement power list system.Because this system is an intense response to administrative subject's 'offside,vacancy and dislocation'.It not only clarified the boundary of power,but also explicited the attribution both power and responsibility.At the same time,it compressed administrative discretion space and made contribution to procedural justice,so does the social supervision.Arguably,government power list system which pregnant with the process of comprehensively deepening reform and fully advancing the law-based governance is an institutional innovation or a revolution in the operation of administrative power.Power list system of provincial level as a connecting link between the proceeding and the following,in the process of carrying it out,is a momentous segment that can not be neglected.This treatise proceeded from the function of controlling power and took 31 power lists as samples to explore government power list system,in addition,drawing support from Case Analysis Method,Empirical Research and Comparative Study,analysed problems in these lists and revealed the defects of the system ulteriorly.Based on research above,the author tried to provide corresponding counter measure proposals.According to statistical data at the beginning of 2016 from State Commission Office Public Sector Reform(SCOPSR),making power lists known to the public has been accomplished.The result shows that 31 provincial governments have all promulgated their power lists,29 of them published responsibility lists further.There is no doubt that the system has received a positive effect.First off,it makes further efforts to clarify the boundary of government power.Secondly,it cuts space for power rent-seekingdown.Thirdly,it enhances the efficiency and standards of the government's affairs.Fourthly,it strengthens normalization and transparency of power operation.Last but not least,it fosters citizen's consciousness of participation.Text analysis result indicates that there are still same flaws which can not be ignored in government power lists,for instance,skimble-scamble power types,obvious quantitative differences,nonstandard authority foundation,blurring power boundary and missing constituent elements in lists.At the technique aspect,reasons of above problems are omnifarious.Particularly,it contains follow 7 aspects:Top-down Design Principle is imperfect;executive agent of the power list dominants list's formation;workforce of list formation is inadequate in quality and ability;the procedure for compiling lists lacks of standardization;implementation of the system is short of extensive participation for administrative counterpart;network platforms of governments are still at the primary stage.Stated thus,we can take the following measures to consummate the institution.1.Reinforce the Top-down Design Principle of power list system.2.Enact the designing subjects of power list scientifically.3.Strengthen the construction of the working team of the power list system.4.Regularise program composition of the power list.5.Establish a unified standard of power list system.6.Consummate supporting mechanism for the power list system.7.Expand social participation in the process of customising list.8.Accelerate construction of the governments' network platform. |
