Study On The Compensation Standard Of Collective Land Expropriation In China

With the rapid development of urbanization in China,the demand for land has expanded unprecedentedly.Meanwhile,the problem of land expropriation is becoming increasingly prominent.From the current system of land expropriation,the subject status of the levied rights holder has not been truly established,and the abuse of public power and the infringement of the rights and interests of the landless peasants have occurred repeatedly in the process of land expropriation.In today’s vigorously promoted urbanization,a large number of farmers are consumed by fast food and change of identity,and the loss of loss of land is not made up.The government uses the scissors difference of land expropriation to make the value-added income be taken into account,and the rights and interests of the landless peasants are seriously damaged.Therefore,it is very urgent and meaningful to study the issue of land expropriation standard and safeguard the rights and interests of farmers’ land increment income distribution.This paper focuses on the compensation standard in the practice of rural land expropriation in the process of urbanization in China.Starting from the existing problems in the process of land expropriation,taking the land expropriation and demolition of some cities in Hunan as the sample,through the case analysis and cases,it is proved that the reasonable reconstruction of the compensation standard is necessary to alleviate the current land expropriation and demolition contradictions and improve the land expropriation and demolition system.From the perspective of rural development and the protection of the rights of farmers’ survival and development,it is clarified that the compensation standard is strictly determined so as to fully guarantee the rights of the landless peasants and to ensure the legitimacy of the administrative actions and procedures of the land expropriation.The rights and interests of the land expropriated objects can be implemented and paid attention to,and the public,fair and fair land expropriation is truly realized,and the object of land expropriation is guaranteed,"the living standard is not reduced and the long-term livelihood is guaranteed".Tn order to solve the problem of land expropriation and demolition standards,this paper,starting with empirical analysis,summarizes the basic theory and basic concepts of the land expropriation compensation standard.Through the summary of the historical evolution of the evolution of the land expropriation and demolition standards,it shows the adjustment track of the land expropriation and demolition standards.According to the current practical practice,such as the policy and implementation of land expropriation in China,some practical problems are pointed out,such as low standard and ununified standard,and the causes of this series of problems are deeply explored.From the perspective of the actual needs and social development of our country,this paper puts forward the idea of reconstructing the compensation standard for collective land expropriation and the policy suggestions of improving the compensation system of land expropriation in China.
