Study On Administrative Mediation Of Doctor-patient Disputes

At present,how to properly solve the dispute between doctors and patients is becoming increasingly urgent.The analysis of the present situation and the cause of the dispute between doctors and patients reveals the nature and development trend of the doctor-patient dispute,and through the analysis of the existing characteristics of the medical disputes in China,and compares the solution mode of the medical dispute between China and other countries,it highlights the urgency and necessity of resolving the medical disputes.There are three ways to solve the dispute between doctors and patients,including consultation,mediation and litigation.However,as one of the solutions to the medical disputes,the administrative mediation mechanism has been disputed by the academic circles and has not fully played its due role in the practice of medical dispute settlement.With the implementation of decentralization and the extension of administrative rights,the importance of administrative mediation should be paid attention to.The administrative mediation has the superiority which other dispute solution method does not have,through carries on the administrative mediation,may avoid the lawsuit mechanism and the consultation system Chinese Medicine dispute profession and the technical question embarrassment,can fundamentally solve the doctor-patient contradiction.The application of administrative mediation in the dispute between doctors and patients to provide Chinese characteristics of the dispute resolution model,in practice,doctors and patients should also provide a more diversified choice.The origin of medical disputes is to explore,it will be found that the doctor-patient disputes in the beginning is due to the doctor-patient communication failure,misunderstanding more,the contradiction intensified after a series of performance,we need to join the negotiations in the administrative mediation reasoning,to create a new model of medical dispute resolution.The application of administrative mediation in medical disputes is in accordance with the requirements of the times,but the actual application of administrative mediation exposes the deficiencies of administrative mediation in the dispute between doctors and patients.Therefore,it is clear that the administrative mediation in the medical and patient disputes,the right remedy,solve the problem.Finally,perfect the administrative mediation system,make up the existing administrative mediation system's insufficiency,let the administrative mediation be usedeffectively in the doctor-patient dispute,optimize the application of the negotiation reasoning,and use Aristotle's Persuasion "three means" to improve the mediation ability of the health administrative mediator.We should improve the application of administrative mediation system and negotiation reasoning,and construct a complete administrative mediation system.The optimization of administrative mediation is not only the need of resolving the dispute between doctors and patients,but also the requirement of harmonious society.
