On The Family Responsibility Of Juvenile Delinquency

“Juvenile delinquency,drug crime and environmental pollution”are The world's three biggest public hazards.The development of minors is related to the rise and fall of the country and the future of the nation.Therefore,it is of great significance to prevent and govern the crimes of minors.With the deepening of the social transition period,the problem of juvenile delinquency becomes more and more exposed.Family,school and society are considered to be responsible for the prevention of juvenile delinquency.Among all the responsible subjects,the family of the minor is the most important subject.Among all the responsible subjects,the family of the minor is the most important subject.Although the current related to the protection of minors the law on the prevention of juvenile crime has a relatively detailed provisions,but compared to the school and the relevant provisions of the society,the families need to perform the obligations of minors regulation principle,need to assume responsibility is lack of execution.This article is based on the current law on the premise of careful analysis,on the basis of the theoretical foundation and realistic demand,combined with domestic and foreign minors generous welfare,national and regional legislation experience,aimed at minors and minor crime of dereliction of duty crime prevention level the responsibility of the family two aspects of accountability to build and perfect our country minor crime family responsibility system,in order to pass responsibility to safeguard minors family upbringing of education an obligation and the realization of the rights and interests of minors' physical and mental health development.The paper is divided into four parts.The first part,concept definition and interpretation of current legislation.Responsibility is a word in the context of strict law should be interpreted as negligence and bear the adverse consequences,but in the field of minor crime,purely for dereliction of duty crime family children bear corresponding responsibility for achieving the purpose of the minor crime prevention effect is limited,the concept of interpretation of the minor crime family responsibility connotation in from the aspect of crime prevention and criminal accountability level after the two levels.After clarifying the connotation of relevant concepts,we find out the shortcomings of the current law of our country by analyzing the current legislation on family responsibility of juvenile delinquency.The second part,to build a new institutional framework,the need of can't depart from thesupport of theory and practice,in order to satisfy the demands of reality,for the purpose of correspondence related theory to study the premise,from the national compulsory,crime prevention needs,and children's rights and interests of the world development and so on several aspects to build and perfect our country's minor crime family responsibilities for dual support of theory.The third part introduces the family responsibility of juvenile delinquency in the welfare state and the area.Reflected in the family responsibility of minor crime in the crime prevention beforehand and afterwards the two layers of accountability,selection of Britain,the United States,Germany and Hong Kong and Taiwan family of minors crime prevention responsibility and accountability for later introduction and analysis,thus to build our country minor crime family responsibility system provide certain enlightenment and reference.The fourth part,combined with the defects and deficiencies of the relevant legislation in our country,proposes some ideas on how to construct and perfect the family responsibility system of juvenile delinquency in China.Crime prevention in advance level,as a result of monitoring the crime prevention is directly related to security and carry out the purpose of implementation,so is mainly for the improvement of the current care intervention system,including the concept of innovation,the improvement of the system itself and the implementation of supporting measures.At the level of accountability after the crime,it is a new system of accountability that includes three dimensions of civil administration and criminal,with a view to guaranteeing the realization of rights through explicit responsibility.
