Research On The Construction Of Judicial Expertise And Credibility System In China

In the current era of establishing a society under the rule of law and emphasizing judicial justice,as an indispensable part of judicial activities,judicial authentication activities aims at providing legal,neutral and reliable judicial authentication service.Judicial appraisal of honesty and credibility will effectively protect the justice and authority of judicial activities,while judicial identification of dishonesty will be counterproductive.Therefore,in the field of judicial expertise in China,research on the construction of judicial expertise and credibility system is imperative.It is found that the integrity situation of the judicial authentication industry in China has a good overall situation,but the complaint for dishonesty on certain problems is still serious and has not been improved,the main reason is that the limitations of the subject of judicial expertise and the supervision system of judicial expertise have some drawbacks.Considering the complexity of the reasons of affecting the integrity of judicial expertise,we should take measures from many angles to improve the current acts of dishonesty so as to create a good atmosphere for forensic expertise.First,a rational analysis of the present situation of credibility and integrity is necessary,even though there is a problem in the judicial identification industry that affects the integrity,the public opinion needs to be correctly guided.Second,about the dishonesty of the subject of judicial expertise,when analyzing consciousness and the behavioral of the subject,judicial authenticators have to keep our mission firmly in mind,grasp of the correct direction of forensic expertise,constantly adapt to the growing demand of people in the legal field,further improve the ability of forensic expertise and promote the integrity and sustainable development of forensic science.Third,it is effective to regulate the supervision of judicial identification from the legal and institutional level.In the fourth Plenary Session of the 18 th CPC Central Committee,the party put forward the reform goal of "perfect and unified judicial appraisal management system",to achieve this goal,the state should pay attention to standardization and unification at the level of law,regulations and technology,and at the operational level,we should reasonably balance the authority of unified management and departmental management,and give full play to the role of administration of the judicial expertise Industry Association.This paper mainly deals with the construction of judicial expertise and credibility system.It is suggested that the judicial authentication industry shall,by establishing credit investigation,archives management,information disclosure and credit information sharing requirement system,introducing both black and red lists,questioning as well as punishing defaulters,gradually forge a nationwide,multi-sectorial and cross-region mechanism with information sharing and assuring strategies and system of rewards and punishments from which faithful judicial authenticators and agencies shall be benefited whereas those defaulters shall be restricted.Meanwhile,it is also of great necessity to perfect the judicial authentication in order to guarantee the authority.
