On The Application Of SPS Agreement In Japan Customs Quarantine Control

Japan has long been an important pole of the world economic structure with the form of a big economic power,but the development of Japan's economy has long plagued by the lack of resources.Japan's urgent demand for all kinds of resources is an important driving force for trade between Japan and other countries,as well as in the fields of animals,plants and their processing products.The problem is that,in order to promote the development of domestic industry,the use of various technical measures to build trade barriers is not a case in the world.Japan is also suspected of constructing technical barriers to trade in the Agreement on the Application of Sanitary and Phytosanitary Mea.sures(referred to as "SPS Agreement")under the framework of WTO,which restrict the import and export of animals,plants and their products.As a member of WTO,Japan should follow the relevant inspection and quarantine regulations under the framework of WTO,namely "SPS agreement".The paper,taking the application of the SPS agreement as the main line,finds out the relevant administrative agencies of the Japanese customs quarantine in the process of applying the SPS agreement,and combs the relevant domestic legislation of the application of the SPS agreement in Japan,especially the regulation measures introduced by the agricultural and forestry Province in the application.On the basis of the previous analysis,the paper puts forward several main problems in the process of applying the Japanese customs quarantine in the application of the SPS agreement,which involves the improper application of the SPS agreement to safeguard its own interests.The trade between China and Japan will also be affected by the improper application of the SPS agreement by Japan,the import and export trade between China and Japan has developed rapidly in recent years,so this kind of disharmony should be restrained.In view of the inappropriate application of the SPS agreement in Japan and the practice of violating the basic tenet of the agreement when applying the SPS agreement,our country should deal with the related problems from three aspects as follows:First,improve the technology levesl and standard of domestic quarantine,in order to ensure that the Japanese import standards can be reached as much as possible;Secondly,China should actively strive for the discourse right of the relevant international standards of inspection and quarantine,we should not be subject to the rules and should try more initiatively rather than passively.Finally,China should initiatively take use of the WTO dispute settlement mechanism to protect the interests of our country in time and firmly when the Japanese improper use of the agreement is damaged and the interests of our country.
