Research On Major Administrative Decision-making Procedures Of Local Government In China

Local government's major administrative decisions are important means for local governments to lead local development,and have far-reaching impact on national interests and people's interests.With the development of science and technology,the matters involved in the major administrative decisions of local governments have more and more professional and technical requirements,and have put forward scientific requirements for major administrative decisions.In China under the new normal state,the government has turned from the control type to the service type,and the citizen's right to participate in the political and political affairs is getting higher and higher,which determines the Democratic requirement of the major administrative decision.Since China has established a comprehensive strategy of governing the country by law,it has also decided that the major administrative decisions have become a legal problem from the leadership of a local government.It is necessary to meet the legality of the procedure of the major administrative decisions of the local government,which is the key to satisfying the science,the people's ownership and the legitimacy of the major administrative decisions.However,there are still many deficiencies in the procedures of major administrative decisions of local governments.This paper attempts to analyze them and improve them.There are five chapters in this paper.The first chapter mainly expounds the background,purpose and significance of this topic,the research status quo at home and abroad,the research contents and methods,as well as the innovation.The second chapter mainly introduces the relevant concepts and characteristics of the major administrative decision-making procedures of local governments,discusses the theoretical basis of the major administrative decision-making procedures,and focuses on the analysis of the 5 basic procedures in the process of major administrative decision-making.The third chapter first analyzes the state and the local legislative status in the major administrative decision-making process,and then combined with the implementation of the local government in the implementation of major decisions,respectively from the public participation,expert demonstration,risk assessment,legitimacy review,and collective discussion five aspects of the problems.The fourth chapter introduces the major administrative decision-making procedure legislation of the United States,Germany and Japan,and focuses on the analysis of the administrative decision hearing system and the expert demonstration system of several countries.The advantages are worthy of our local governments to use their own actual conditions for reference.Finally,this paper puts forward some suggestions on the problems existing in the major administrative decision procedure of local government in China,and thinks that the local government should pay attention to the disclosure of decision-making information in the process of major administrative decision-making,fully mobilize the enthusiasm and ability of the public participation,do a good job of expert demonstration,and perfect the construction of the system of expert selection and expert system and the construction of the expert library.Establish a scientific risk assessment system;establish a dynamic legal review mechanism to ensure the legal status of the subject of legitimacy review;in the collective discussion,we should grasp the relationship between the democratic centralism and the head responsibility system.The construction and implementation of the major administrative decision-making process is directly related to the quality of the major administrative decisions and the interests of the public.It is an important link in the construction of the rule of law government.It is of great practical significance to study the subject.
