Research On Major Administrative Decision-making Process Under The Background Of Digital Government Ruled By Law

The Outline for the Implementation of the Construction of a Government under the Rule of Law(2021-2025)puts forward the construction goal of "digital government under the rule of law" for the first time,puts forward new requirements for the deep integration of informatization and the rule of law,and emphasizes the optimization and innovation of government governance processes and methods.The construction of a digital government under the rule of law will become an important background for the study of administrative rule of law at this stage.The construction of major administrative decision-making procedures is an important task of the construction of a government governed by law,and also an important content reflecting the legalization of government governance.In the context of the construction of a digital government ruled by law,the State Council issued the Guiding Opinions on Strengthening the Construction of a Digital Government,which put forward new requirements for the digital technology-assisted administrative decision-making mechanism.Under the guidance of the top-level design,it is necessary to bring the construction of major administrative decision-making procedures into the context of the construction of a digital government ruled by law for research,analyze whether the existing major administrative decision-making procedures meet the digital standards required by the construction of the digital rule of law,find out the inadequacies,and explore the way in which digital technology is applied to major administrative decision-making procedures to help improve the democracy,scientificity and legitimacy of major administrative decisions,We will build major administrative decision-making procedures that meet the requirements of building a digi tal government ruled by law.Based on the analysis of the development of the construction of the rule of law and the construction of digital government,this paper analyzes and combs the central policy texts,and obtains the basic connotation and requirements of the construction of the digital rule of law government,mainly including paying more attention to the digital application in the construction of the rule of law,and paying more attention to the guarantee of the rule of law in the digital application.At the same time,it defines the concept of major administrative decision-making procedures,clarifies the basic attributes of administrative decision-making,summarizes the five characteristics of major issues,and sorts out the six main procedural links included in major administrative decision-making procedures.On this basis,by means of empirical research,this paper combs the development status quo,analyzes typical cases,summarizes the main problems existing in the major administrative decision-making process at the present stage,and puts forward the following views: We should comply with the trend of digital development,give full play to the advantages of digital technology in all aspects of the major administrative decision-making process,and assist in the making of major administrative decisions;At the same time,we should recognize the limitations and hidden risks of digital technology,provide legal protection for the application of digital technology by improving legislation and standardizing the use of digital technology,and ensure that major administrative decision-making procedures under the background of digital government under the rule of law always meet the requirements of science,democracy and legitimacy,and contribute to the continuous promotion of the construction of a government under the rule of law.
