Research On Intellectual Property In Long-term Preservation Of Digital Resources

With the advent of the digital information age,all the information resources that we have been exposed to in our daily work,study and life have gradually changed from paper-based to digital.As a new emerging thing,the existence of digital resources,although greatly improved the efficiency of users to use information,but also to the long-term preservation of digital resources has brought a certain degree of challenge.Because of the existence of carrier aging,technology and other factors,digital resources themselves are very fragile,if the lack of effective long-term preservation strategy,people’s production and life are affected to a certain extent.It is against this background that the long-term preservation and long-term effective utilization of digital resources are attracting more and more attention from all over the world.There are many problems to be solved in the study of the long-term preservation of digital resources,such as law,technology,economy and so on.In legal issues,the most important is the problem of intellectual property.If the problem of intellectual property rights is not dealt with well,it is likely that the research that is beneficial to the people has become a violation of the legitimate rights of the people.Therefore,only careful study of intellectual property rights can make digital resources better used by people.This paper starts with the concept and meaning of digital resources,and then studies the long-term preservation of digital resources.Through the study of its concept,meaning,practical projects and OAIS model,it can be found that there are many factors that can affect the long-term preservation of digital resources,In the author’s opinion,the major impact of which is mainly technical,economic,legal these three factors.Then,from the perspective of law,the author comprehensively analyzes and analyzes the intellectual property problems faced in the long-term preservation of digital resources and concludes that the main problems lie in the right of reproduction,the dissemination of information network and the protection of copyright technologies.Finally,the author puts forward the following personal suggestions on how to solve the intellectual property problem in the long-term preservation of digital resources in our country:(1)Make full use of fair use system.Due to the fact that there is no explicit stipulation on interim copying in our country’s current law,we should increase the provisions on interim copying,formulate relevant standards,and make provisional copy that meets the conditions as fair use,otherwise,it will be deemed as infringement.At the same time,due to the unavoidable crack of certain copyright technical protection measures in the research of long-term preservation of digital resources,the legitimate techniques of circumventing copyright should also be included in the fair use category.(2)The introduction of statutory licensing system.Long-term preservation of digital resources,such as libraries,to a limited extent,allows the research on long-term preservation of digital resources to make better progress,bring benefits to the public and at the same time bring real economic benefits to copyright owners Income,also has a positive effect on the individual.(3)The use of a variety of cooperative preservation system.At present,our country lacks an effective long-term cooperation system.Therefore,we should actively participate in international projects,draw lessons from the experience of other countries and establish a system of effective preservation and cooperation based on the actual conditions of our country by comprehensively using various cooperative preservation systems.(4)Establishing and improving the deposit system of digital resources.The establishment of digital resource filing system can not only properly handle a part of intellectual property issues and make the cultural heritage of mankind more perfect,but also make it easier for the public to access and utilize the necessary digital resources through the Internet platform.Safeguard public interests.(5)Strengthen collaboration with other agencies.In the project of long-term preservation of digital resources,strengthening collaboration with copyright owners,publishing agencies,government agencies and other agencies can create a broad-based social atmosphere and absorb opinions so that the decisions made are more accurate and effective and solve the problem more quickly.
