The Property Rights Risk Of Personal Digital Archives In Long Term Preservation And Countermeasures Research

The Personal Digital Archive(PDArc)refers to the original or reproducible digital documents produced by individuals in daily life for a certain purpose.For individuals,Personal Digital Archives(PDArcs)are precious digital memories of individual and his family,for society,they are an important part of national memory and an important bearing of national culture.Thus,the long-term preservation of personal digital archives become an inevitable demand in the digital age.Compared with other digital resources,the relationship between the personal digital archives and the main body is more closely,and the problem of property rights in the long-term storage is particularly prominent.The starting point and the ultimate goal of this paper to analyze the property right risk caused by property right and to find a feasible strategy.The formation of PDArcs comes from the daily life of individuals,including personal labor and wisdom,during the collection,processing,preservation and use of the personal digital archives,the violations of intellectual copyright rights and the privacy rights seems to be Inevitable,therefore,the property right risk of personal digital archives can be divided into the copyright risk and personal data protection risk.There are four main reasons caused the copyright risk.Firstly,the ambiguity of copyright holders,the ambiguity of the copyright holder causes the repositories unable to obtain the appropriate authorization.Secondly,the inadaptability of current copyright law,the current copyright law can not adapt to the changing digital environment and can not provide accurate guidance in many cases.Thirdly,limitations of the application of Creative Commons frame,Creative Commons protocol is widely used in the world,however,there are some problems in the actual use of the protocol,which makes it impossible to completely solve the copyright problem by only relying on the Creative Commons protocol.Fourthly,the ambiguity of copyright licensing terms,users can not accurately grasp the contents of the agreement when facing the fuzzy copyright license,leading to violations may occur,even users choose to be worldly-wise and play safe,refuse the information exchange.The reasons of forming the risk of personal data protection,mainly in the following three aspects.Firstly,the absence and adaptation of the current personal data protection act in the digital environment,the legal protection of privacy in our country is relatively scarce,especially in the digital environment,which result in the lack of effective guidance for the protection of personal privacy in reasonable information communication.Secondly,recognition of personal privacy data,because of the explosive growth of individual generated content,it seems to be an endless task to identify personal sensitive information when faced with a large number of PDArcs.Thirdly,the use of personal privacy data,in order to reduce the risk,the repositories impose severe restrictions on the use of digital resources that contain sensitive information,which lead to the users can not get reasonable personal digital resources,or to bear a lot of legal risks.According to the above analysis results,sum up the commonness of these problems,the author found that the occurrence of the problem is mainly affected by four aspects: Imperfection of laws and regulations,the change of the moral concept between the reasonable communication and the protection of property rights,the repositories management is not standardized,the technical force is weak.An antidote against the disease.This paper expounds the coping strategies from six aspects: perfect the legal constraints,strengthen moral restraint,establishing a framework for PDArcs long term preservation,establish and perfect the repository risk management process,establish a standardized metadata standard,the development of digital terminal tool.This is the key part of the full text.This paper focuses on demonstration.In order to make the article as much as possible,reasonable,simple and easy to understand,in the process of problem analysis and strategy elaboration,there lists a large number of examples,constructs some processes and combines with some charts.
