Study On The Resettlement And Management Of Punished Release Of Prisoners

Released prisoners as the focus of the comprehensive management of social management in China and control special populations.Under the unified leadership of the governments at all levels,the special administrative groups are led by the judicial administrative agencies and rely on the relevant functional agencies and social forces of the government.The purpose of resettlement and assistance management is to help and educate the release of prisoners to return to society.At the present stage,the management system for the resettlement and repatriation of people released from prison has been established in the early days of the founding of the People's Republic of China,and consolidated in the 1990 s.This system has played an important role in ensuring social stability and has greatly reduced the occurrence of re-offences of crimes.With the development of economy,advancement of the rule of law,and the transformation of government functions,the current resettlement management system has been unable to adapt to the requirements of the new period.In particular,the report of the 19 th National Congress of the Communist Party of China clearly stated that the new period should strengthen the social governance system.It is imperative to establish and improve the social governance system in which party leaders are responsible,the government is responsible,social coordination,public participation,and the rule of law guarantee.This article introduce the main content and historical evolution of the management of resettlement assistance and education in China,compare it with the social protection theory and practice of foreign prisoners,and analyze the status quo and operating mechanism of the present working mode in China.The lack of top-level system legislation in the management of resettlement,remedial and teaching of the release of prisoners in our country has a low level of effectiveness,poor operability,multi-headed management,and their own governance.The powers and responsibilities are not uniform and the management coordination is ineffective;information is not smooth and disconnected.Obviously the phenomenon is obvious,help management cannot keep up with economic and social development,the phenomenon of leakage management is serious,the responsibility for the front-line resettlement assistance and teaching work at the grass-roots level is heavy,the input power is relatively weak;the teaching and education work fails to achieve full coverage,and “management and control” is more important than “assistance”,and teaching management The quality of personnel needs to be improved,the development path for participation of social organizations in teaching remains to be developed;the employment channels for resettlement are narrow;the phenomenon of “employment difficulties” among prison staff is more serious;the prison release personnel are being supervised for a long time,the skills are lacking,the job requirements are not fulfilled,and social prejudice is discriminated against.Directly affecting the release personnel Key issues such as industry and life.Learning from the advanced concepts of developed countries and learning from the excellent experiences and practices of developed regions in China,we further propose that China should first formulate laws and regulations concerning the management of resettlement,rehabilitation,and teaching of release of prisoners.reducing the rate of reoffending of persons released from prison and helping such special groups to integrate into the society as soon as possible and start normal life as soon as possible,thereby promoting our country to build a shared governance.Social governance grid the building process.
