Study On Drug-related Crimes Of Drug Addicts In China

At present,the problem of drug-related crime in our country is still severe and complex,drug addicts are becoming an important implementing subject of drug-related crime day by day.Drug addicts themselves have a certain particularity,which increases the difficulty of drug crime management.The study of drug-related crimes of drug addicts can provide some theoretical guidance for judicial practice and promoting the development of drug control work in China.In order to better study the drug-related crime cases of drug addicts,350 drug-related crime cases and 150 drug-related cases involving non-drug users in China's adjudicative documents network were gathered.After analyzing all the cases,according to the detailed description of the cases and the criteria for the study,224 drug-related crime cases for drug addicts and 107 drug-related crime cases for non-drug addicts were screened for study.It also tries to reveal the characteristics and reasons of drug-related crimes of drug addicts,and summarizes the countermeasures to prevent and control drug-related crimes of drug addicts.This paper is divided into five parts:The first part is the definition of concepts.The concept of drugs,drug addicts,drugrelated crimes,drug-related crimes are defined.Due to the fact that there is no definition of drug-related crime in academic and judicial practice,this paper draws lessons from the concept of drug crime to define it.Because the types of drug-related crime cases are relatively centralized in practice,the scope of this study is limited to the crime of drug trafficking,the crime of transporting drugs,the crime of illegal possession of drugs and so on.The second part is the current situation and characteristics of drug-related crime of drug addicts in China.Through the statistics and analysis of the cases studied in this paper,the characteristics are obtained,and describes from three aspects: the overall situation,the main features and the characteristics of the cases.The third part is the reason of drug-related crime of drug addicts in our country.Analyzed from the individual factor,economic factor,culture factor,legal factor and government management factor of drug addicts' crime,the internal and external reasons of drug addicts' drug-related crime are obtained.The fourth part is the perfection of the measures to prevent the drug-related crimes of drug addicts in China at present.This part introduces the great efforts and achievements that our country has made in dealing with the drug-related crimes of drug addicts at presentand puts forward the shortcomings of the current work in the light of the actual situation of the current governance work.In the fifth part,some suggestions on how to prevent the drug-related crimes of drug addicts in China are put forward.Combined with the reasons of the third part,base on fully considering the shortcomings of the current work and drawing lessons from the advanced experience at home and abroad,suggestions on improving the effect of control,promoting publicity and education,perfecting laws and regulations,optimizing government control,etc are put forward.
