Privacy Protection In The Application Of Public Video Monitoring System

With the development of economy and science and technology,modern government faces more and more challenges in managing society.The public video monitoring system has more advantages in the management of social order and cracking down on various illegal crimes,so it is applied to manage society by the government increasingly.Although the extensive use of the public video monitoring system is convenient for the government to manage society,stabilize social order,improve security of people,the influence on civil rights,especially the right of privacy,is inevitable.Therefore,how to regulate the public video monitoring system which is widely used and to protect the privacy of citizens is the main problem to be discussed in this paper.This paper uses comparative analysis method and learns lessons from other countries about the advanced management experience of public video monitoring system,and then combines with the reality of our country to explore how to obtain the balance between the application of the public video monitoring system and the protection of citizen right of privacy.The basic ideas of this paper: 1.Further improve the legislation of privacy,including the right of privacy clearly written in constitution,improve more privacy regulations in other laws to strengthen the protection for citizen right of privacy.2.Formulate special legislation on public video monitoring system through the national level,which strengthens the regulation of public video monitoring mainly from the aspects of video monitoring setting,daily supervision and the use of video information data,so as to effectively control the disorder of the actual application of public video monitoring system and protect citizen right of privacy.The specific structure is as follows:The first part mainly introduces some basic theories about the public video monitoring system and privacy,including the definition of public video monitoring system,main functions,widely used theoretical basis,as well as the generation and connotation of the right of privacy,and the right of privacy in public places.The second part mainly expounds the application of public video monitoring system in China,the invasion of privacy,and the status of law protection for Chinese privacy.The third part analyzes the management experience of public video monitoring system in other countries so as to provide a reference for Chinese rational regulation of public video monitoring system.The fourth part mainly puts forward relevant legislative suggestions to perfect the right of privacy,through writing the right of privacy in constitution,perfecting the privacy regulations in other laws,formulating specific legislation about public video monitoring system at the national level,so as to obtain the balance between the application of public video monitoring system and the protection of citizen right of privacy.
