Deep Studies Upon Several Issues Around Prosecutorial Supervision In Supervision System Reforms

Once establishing supervisory commission,it's of much necessity to adopt multiple measures to ensure it can fully fulfil its functions and powers by law.On the other hand,it's equally important to implement necessary and appropriate restrictions to its powers to avoid awkward situation that overdone is worse than undone in a series of supervision system reforms for the purposes of fully protecting human rights,performing normative supervision powers,increasing supervision-authority credibility and further ensure such supervision powers can be correctly run in the way to “Governed by Law”.All case involving in duty crime,handled by supervision commission,shall be transferred to procuratorial organs for making further prosecution.Even more,in process of filling or retaining case,it's worth studying whether or not procuratorial organs shall conduct appropriate intervention of necessary supervisions.Meanwhile,it's also particularly important around how procuratorial organs shall appropriately perform its supervisory powers for ensuring overall case quality.On the basis of deeply analysis upon the current situation and disadvantages occurred when supervising its supervision powers,this paper further explored the advantages of the existing prosecutorial-supervision system.By taking all stages when supervisory commission deals with similar cases as starting points,it well clarifies the relationship between prosecutorial supervision and “Judgment Centralism” in a series of supervision system reforms and further explored some issues procuratorial organs might face when performing their supervision powers in such system reforms for trying to find better solutions.Besides that,it proposed some system visions and recommendations in prosecutorial supervision practices for really forming one kind of interactive and interdependent working mechanism between prosecutorial organs and supervisory ones.
