Research On The Supervisory System Reform Of China

The supervisory system reform of China is a major political reform.It is the summary anti-corruption experience since the eighteenth national congress of the communist party of China on the basis of the anti-corruption in the new situation of major strategic deployment.In November 2016,the standing committee of the National People's Congress decided to carry out the supervisory system reform pilot work in Beijing,Shanxi and Zhejiang three provinces and municipalities,one year later,in November 2017,the standing committee of the National People's Congress decided to open supervisory system reform pilot work in the country on the basis of summarizing the pilot experience in three provinces and cities.At present,the pilot work of the national supervision system reform is steadily advancing.As of March 31,2018,all levels of the national supervisory commission have been completed,had set up national supervisory committee,come out the amendment to the constitution,promulgated the national inspection act,it is going to change a series of laws and regulations related to the supervision of the and so on in the future.The supervisory system reform of China methodically carry out,it's also have appeared a lot of trouble at the same time,that the emergence of these difficult dilemma not only embodies the focus of supervisory system reform,but also show the future direction of supervisory system reform.This paper makes an in-depth analysis of the current situation of supervisory system reform,focuses on the key issues of reform,and then puts forward concrete solutions,which has high guiding value for the supervisory system reform.Empirical analysis on three provinces and cities and all the countries' pilot work,the writer finds three major problems need to be solved which in the process of supervisory system reform: First,legal issues,including legal due process,human rights protection and lawyer intervention;Secondly,the relationship between the supervisory organ and the procuratorial organ and the judicial organ should be identified;Finally,the conflict of the unified leadership.Based on the above problem,by learning the supervisory system reform pilot results accumulation,draw lessons from the Chinese ancient supervisory,modern Hong Kong and Taiwan,the supervisory system of outside Singapore experience,combining a series of academia on supervision system reform thinking,the article puts forward a solution to the above three problems based on the separation of powers under the guidance of theory,the principle of the rule of law and human rights protection,,from the three aspects of the qualitative,supervisory committee's power exercise and supervision of the supervisory commission,in order to make reference to the progress of the national supervisory system reform pilot work.
