Study On Government Procurement Of Public Legal Services

In foreign countries,the government's purchase of public legal services has been a universally applicable system.It is only in recent years that China has put forward the idea of government buying public legal services.But it does not mean that there is no similar system in our country before this claim.In the early years,China always purchased public legal services in the form of government legal adviser.However,with the development and progress of the society,the public demand for public legal services is increasing,and the types of services that need to be provided are also increasing.The need for this rapidly growing public legal service cannot be fully met by government departments within the government.The government could not complete the objectives of the administration according to the original system.In this situation,as well as in promoting the government offered to foreign purchase under the background of public services,local governments at all levels in our country is generally realized only by way of legal adviser later already cannot satisfy the requirement of work.Therefore,they began to use the legal resources outside the system,namely,to purchase public legal services,to promote their ownadministrative work.In this paper,the author firstly reviews the basic theory of government purchase of public legal services,and how to determine the government purchase of public legal service system in the purchase of the main body,and to undertake to clear the government purchase of public legal service system in the purchase limits proposed own view.The paper introduces the purchasing mode in practice in China.Analyzing the value of government purchase of public legal services.Under the premise that the government buys the basic theory of public legal service,the paper discusses the practical situation and summarizes the existing problems: The government's laws and regulations on the purchase of public legal services are not yet sound;The buying line is not clear.The purchase process is not sound;The information disclosure system is imperfect;The supervision mechanism is not perfect.In the lase part of the article,the author puts forward some suggestions on the problems in practice:Improving the relevant laws and regulations;Define the limits of government purchase of public legal services;To refine government procurement procedures for purchasing public legal services;Improving the information disclosure system;Improving oversight mechanisms for government procurement of public legal services.
