On System Of Village (Residential) Legal Advisor In Huizhou City Under The Perspective Of Government Purchase Service

At present,China is in a critical period of transforming and upgrading of both social and economic development,social conflicts happen frequently,and the pressure of stability maintenance is increasing.Therefore,it is urgent to change the thinking of use forceful measures to maintain stable.But effectively protect the rights and interests of citizens,eliminate social conflicts from the source,and truly achieve long-term peace and stability.The Fourth Plenary Session of the 18 th CPC Central Committee proposed “promoting the construction of public legal service system covering urban and rural residents and strengthening legal services in the field of people 's livelihood”.This requirement proposes high demand of public service capabilities of ensure livelihood and maintain stable for judicial executive department.Huizhou city,the "frontier" of reform and opening up in Guangdong Province,has carried out practical exploration of the village(residential)legal advisory system earlier,and pioneered the establishment of the village(residential)legal advisory system in China.At this stage,the village(residential)legal advisory system has been fully implemented in Huizhou,and has achieved certain results in practice,especially in improving the legal knowledge of citizens,dealing with neighbourhood conflicts,maintaining rural stability and improving the construction of rural legalization,etc.The system effectively improving the quality of public legal services.However,due to various factors,the implementation of the village(residential)legal advisory system also has many problems that require in-depth analysis and research.This paper takes Huizhou as the research object,through literature analysis,questionnaire survey,interview and other methods to understand the implementation status of Huizhou village(resident)legal advisory system.According to the study,there are some problems exists in the Huizhou village(resident)legal advisory system,such as: the differences in the work and service quality of legal consultants,the irregular recruitment and management of legal consultants,potential role conflict of consultant lawyer,the insufficient care of differences in village(residential)service demand,etc.However,the main reasons to cause these problems above are: the fuzzy qualitative of village(resident)legal advisory service,the unsound mechanism such as the government purchase legal service,requirements feedback and service monitoring,and the guarantee of public legal service system.Based on government perspective of purchasing legal service,the author proposed some countermeasures to improve the village(residential)legal advisory system in Huizhou,for instance: to clear qualitative the service of village(resident)legal advisory,to perfect the mechanism of government purchase legal service,requirements feedback and service monitoring,and the guarantee of public legal service system.
