Research On Legilation Of Medical Record Managment In Medical Institutions In China

In 2013,the National Health and Family Planning Commission and the State Administration of traditional Chinese Medicine revised and perfected the Regulation on the Management of Medical Record of Medical institutions issued by the former Ministry of Health in 2002.Formed the Regulation on the Management of Medical Record of Medical institutions(2013 Edition).But objectively speaking,due to the low level of the legislation,the new regulation conflicts with the relevant legal norms.The lack of regulation on medical record management and supervision mechanism and legal responsibility in the new regulation,as well as more improper regulation on medical record management system in medical institutions,lead to confusion in the application of the new regulation.In practice,there are a series of phenomena that do not follow the rules,and even the new regulation appear to be on the road of nothingness.The state should attach importance to deeply study the legislation of medical record management in our country,with a view to perfectingthe medical record management system of medical institutions in our country.This article will be from the perspective of administrative law,taking Regulation on the Management of Medical Record of Medical Institutions as the main entry Point,analysis and research on the legislation of medical record management in medical institutions in China.Through the definition of the concept of medical record,the kind of medical record,the nature of medical record,the main body of medical record management and the legal value of medical record,it proves the legal significance of strengthening the management of medical record and the necessity of legislating the management of medical record in the first part of this paper.At the same time,this part summarizes the current situation of medical record management in China and makes a brief analysis,which lays a foundation for the analysis of the existing problems in the legislation of medical record management.The second part of this paper studies many problems existing in the legislation of medical record management in medical institutions of our country,including the imperfect legislative system of medical record management in medical institutions,the lack of regulations on supervision mechanism and legal liability in the legislation of medical record management in medical institutions.The third part of this paper puts forward some suggestions on the legislation of medical record management in medical institutions in China.First,to clarify the concept of medical record management legislation in medical institutions in China.Secondly,the path of the legislation of medical record management in medical institutions in China is put forward clearly.Then,it is suggested that unified regulations on medical recordmanagement should be formulated,Regulation on the Administration of Medical Record of Medical institutions,for example.And the author hopes to have a full and effective legal basis for the management of medical record in medical institutions from now on.Finally,the legislative principles of the Ministry's legislation are discussed.The common and professional principles that should be included in the legislation of medical record management.At the same time,it is suggested to increase the supervision mechanism and legal liability regulation of medical record management in medical institutions in China,so that the legislation can be carried out and followed from one to the last.This paper also discusses the establishment of scientific and effective medical record management system.
