The personnel reform of the court is an important part of the comprehensive deepening of the reform of the judicial system.As an integral part of the field of personnel reform,the classification management system of judges assistants plays a key role in the reform of the judicial system.Since 1990 s,our country has begun to "test the water" assistant system of judges,but in the past decade,after the deepening of the judicial system reform,the effect of "thunder and rain" is not clear.Since the reform of the judicial system,judicial assistant system quickly spread throughout the country,the emergence of a large number of assistant judges,the lag of the construction of management system has become extremely prominent,the controversy around the theoretical orientation,occupation duties,appointment,evaluation and other management issues also linger on faintly.This article is intended to participate in the discussion of the above problems.The full text is divided into three chapters.The first chapter is the basic theory of the assistant management system of judges.The part from the connotation of judge assistant management assistant judges occupation,the aspects of the concept of judge assistant management system of interpretation,the following discussion on this system to deepen the reform of the judicial system of the comprehensive value,including the post system,judicial responsibility system reform and the law school team "three" for promoting the construction and so on,at the same time the investigation and review of Anglo American law system,continental law system of major countries and regions in this system.The second chapter is the analysis of the status of the assistant management system of the judges in China.This part first examines the overall situation of judge assistant management system since the end of 1999 s from a macro perspective,and comprehensively sets up the social background,value orientation and main initiatives of this reform.Secondly,it focuses on the typical model of local court practice in China,and evaluates its effectiveness.Finally,it is also the focus of this chapter.From the aspects of legislative norms,responsibilities,selection criteria,assessment and promotion mechanism,this paper analyzes the problems and causes of judge assistant management system at this stage.The third chapter is the countermeasures and suggestions.Based on the influence of the new era of new era on the reform of judge assistant management system,this part puts forward some ideas from the three levels of idea,system and supporting mechanism to optimize the management system of judge assistant at this stage.
