Inside the court personnel classification management is an important content of the ongoing reform of the judicial system,the aim is to build in as the center of gravity,the trial judge as the core of classified management mode.The judge assistant system is the management of different categories of personnel system is one of the most important in a series of system.The current our country's judge assistant system has power and responsibility is not clear,the selection mechanism is not sound,safeguard mechanism,absence of evaluation mechanism,etc.Paper to our country's judge assistant system as the research object,in the perspective of the people's court for judicial personnel classification management reform,to the status quo of the judges assistant system in China and the analysis of existing problems,and demonstrated the necessity of perfecting the judge assistant system,and puts forward some concrete measures of perfecting the judge assistant system.This article except introduction and conclusion,the text is divided into four parts: the first part is to define the judge assistant system.A brief introduction to the basic concept of the judge assistant system and the basic characteristics of the judge assistant: adjuvant and has relative independence.On the development process of the judges assistant system was introduced in brief.The second part is about the classification of the judicial personnel management reform under the background of the necessity of implement the judge assistant system research.First,the classification of construction professional judges and court personnel management needs;Second,is the scientific division of labor to realize judicial work and judge the need of scientific management;Moreover,meet the needs of the legal value of fair and efficiency;Finally,be beneficial to cultivating the judge candidates.The third part is about the problem analysis of the existence of the judge assistant system.The main performance is: the judge assistant and clerks accrual intersection,the judge assistant and the judge duty confusion.Secondly,this paper discusses the current practice the judge assistant system facing difficulties.Mainly includes: the selection mechanism is imperfect,evaluation and protection mechanism is not sound.The fourth part is the Suggestions are put forward according to the improvement of the system of judge assistant.Brief introduction of the experience of the United States,Germany,the judge assistant system,and problems existed in the third part the judge assistant system of corresponding perfecting suggestion.
