A Study On Overseas Pursuit Of Corruption Criminals In China

China's anti-corruption work has always attached great importance.The party and the government have repeatedly emphasized the urgency of the fight against corruption.In recent years,new features have emerged in China's anti-corruption work.For example,some corrupt elements have fled large amounts of cash to flee their countries or are being turned over to other countries through money-laundering in order to evade domestic legal sanctions.These violations not only undermine social and economic interests,cause massive property outflows,but also severely cripple the credibility of the political system and even endanger the security and stability of the country.Since the 18 th CPC National Congress,under the leadership of General Secretary Xi Jinping,the CPC Central Committee has repeatedly stressed the importance of international hunting and hunting work.Therefore,we must step up efforts to combat corruption and corruption and put the recovery of outflow of assets at the top of anti-corruption in foreign countries.Although cross-border illicit stolen goods is the last step in combating corruption,it is also a crucial step because it is directly related to the effectiveness of anti-corruption.However,there are still many problems in the current international anti-corruption cooperation mechanism and there is still a long way to go.Therefore,we need to review the status quo and practice of overseas stolen goods.And we laid special stress on analyzing the theoretical problem and realistic predicament.Then we try to find effective solution,from improving legal system and supporting measures expanding the measure of overseas pursuit to enhancing international cooperation against corruption.Through comparative analysis,comparison and seeking differences,the countermeasures are put forward.The innovation of this paper lies not only in analyzing the current situation in China,but also referring to the systems and practices of other countries and regions in the world and studying the international system.There are both theoretical and practical aspects as well as new international experiences and perspectives that can be borrowed from.This article is divided into four chapters,composed of the following parts:The first chapter is the basic concept and content of the stolen goods cross-border pursuit,at the same time also outlined China's investigation of stolen goods.We describe the difficult position such as active extradition difficulty,limited use of alternative measures for extradition and disparaging pursuit of stolen goods.In the second chapter,we laid special stress on analyzing the theoretical problem and realistic predicament.Non-Extradition of Nationals,Non-Extradition of Death penalty criminal etc.blocks our active extradition.The research on alternative measures for extradition is insufficient.The legal system of anti-corruption is incomplete.The low level of international cooperation is partly responsible for realistic predicament.The third chapter uses the comparative analysis method to describe the special problems that some countries and regions are faced with and the common problems the international community faces in the process of recovering the stolen goods.Then,we summarize the advanced experience and pave the way for the following.The last chapter is the key part of this article,and puts forward constructive suggestions on the above issues.These proposals include both macro and micro aspects.
