After Theodore W.Schultz introduced "Capital" into education,the concept of "Family Capital",namely,families with better economic status have more family capital for their wide range of available social resources,has largely attracted people's attention.It is obviously different in children's educational opportunities and education quality under distinct family capitals.Based on the equality and fairness of education,it is proved that parents' participation in children's school education plays an influencing role in children's educational attainment,that is to say parents' participation in children's school education can narrow the educational attainment gap due to family economic status.Meanwhile,the necessity of parental participation in children's school education can also be explained from human development ecology theory and Erik Homburger Erikson's stages of psychosocial development.The theory of human development ecology emphasizes the influence of individuals' ecological environment to their development.Parents' participation in school education which has an impact on the ecological environment of children,can affect children's educational attainment.Students in compulsory education stage are in the crucial period of psychosocial development.And parents' participation in school educational activities can promote children's development of interpersonal relationships and completion of tasks in different development stages,which is conducive to the children's development in different psychosocial stages.Based on the above three theories and combined with the value change of educational legislation in China—from educational instrumentalism to educational rights,and with the natural right attribute of parents' education participation right as well as with its current legislative situation and so on,it is justified to conduct legislative activities for parents' education participation right.Therefore,the author of this paper endeavours to academically study on its legal rights,obligations and remedies so as to realize its legal status and to make special legal documents for Parents Committee to ensure the smooth operation of parents' education participation right.The main chapters of this paper is briefed as follows:Introduction: Mainly introduce the study background,study methods,technical approaches,literature review and etc.Chapter One:Explain the relative concepts,nature and logical transformation of parents' education participation right.Chapter Two :briefly present current legislative situation of parents' education participation right in Taiwan,China and foreign countries.Chapter Three: Analyze the current situation of parents' education participation right during children's compulsory education in China and its reasons.Chapter Four: Elaborate the rationality and legitimacy of the legislation necessity of parents' education participation right during children's compulsory education in China.Chapter Five: Discuss the countermeasures and implementation mode of parents' education participation right during children's compulsory education in China.
