Abstract/Summary:
The following thesis consists on a bibliographical study and critical analysis of the legal questions that arise from the tension existent in International Human Rights Law and U.S. Constitutional Law between parental rights, the rights of children, and the State and Community interests in issues pertaining education. On the following pages you would find analyzed issues such as the right of parents to direct the upbringing of their children, the right of children to form their own consciences, home-schooling, the regulation of private education, class exemptions requests, religion in the public education curriculum, among others.;This work is intended mainly for students and professionals of the legal field interested in the legal developments related to the aforementioned issues. For this reason, the main source for this study is case-law. However, this study may also be useful for anyone interested in education policy and especially to students and professionals of the children education field. While the familiarity with the reader with some basic legal principles is assumed, a chapter is devoted to the introduction of the most relevant legal concepts so no previous specific studies on the subjects of the thesis is required.
