| The eighty-third of <Constitution of the People's Republic of China> stipulates that "local procuratorates exercise procuratorial power independently,without the interference of local state organs." But the current reality is that China's Procuratorate is the lack of independence.And the reason is mainly that the security of human resourcese and properties of local procuratorate at the same level is attached to the the government of local Party committee.To execute jurisdiction failed to break the local judicial barriers,the localization of jurisdiction is very serious,greatly reduce the recognition of procuratorate from the broad masses of the people.Since the third Plenary Session of the 18 th CPC Central Committee,the launch of a new round of judicial reform,which is an important part to promote the management of human resourcese and properties below the provincial procuratorate.This article discusses comprehensively the management reform of human resourcese and properties below provincial procuratorate,and analyzes the background and legalization significance,elaborates on China's provincial procuratorate under the unified management of the content of the reform,analyzes the possible obstacles,and puts forward the solving measures,provides a reference basis for China's procuratorial power independently.This paper is divided into four parts,the first chapter summarizes the procuratorate management system,illustrates the status quo of China's Procuratorate management system,history and domestic mode;the second chapter explains the situation below the provincial procuratorate unified management in the background of the reform of the judicial system of the necessity and the enlightenment;third chapter the content of the reform of people's Procuratorate belongings unified management below the provincial assessment;the fourth chapter based on the analysis of latent after the reform will further improve the system and put forward specific measures. |
